Client
real estate agent was denied a significant commission for his
work in finding a buyer and closing the sale of an apartment
building because the real estate broker thought there were
irregularities in the client's performance as agent for the
broker and seller. Client sued the broker agency for the commission
and after having convinced the broker that he would lose the
litigation if the case went to trial, the broker settled by
paying the client his commission.
Client student
nurse was denied graduation from her nursing school after
having paid the tuition with a federal loan due to irregularities
in the school curriculum which were not the fault of the client
but of the administration of the trade school. Client sued
for breach of contract and won tuition payments and damages
for inability to pursue graduation work.
Client
sold business for several hundred thousand with terms of down
payment and interest paid quarterly for several years with
balance of purchase price paid at end of contract term.
Downturn in economy caused buyer to default on interest and
claim client breach in accounting disclosure requirements
included in purchase agreement. This firm litigated for
the client and buyer ultimately agreed to full payment of
settlement amount at time of resolution.
Contractor
induced client to build using contractor's services by giving
inflated budgets to appraisers for two proposed projects.
The result of inflated appraisals did cause the client's
reliance that the building projects being offered were very
good investments. At completion of building, final
appraisals showed value of the two properties built at
$250,000.00 less than initial appraisals. This firm sued
contractor for fraud and obtained a non-dischargeable judgment
for client in the amount of $250,000.00 as well as
punitive damages of $250,000.00 also awarded by the court.
This attorney
has litigated enforcement of terms of many verbal agreements
where there arose a dispute as to what agreed terms were.
Most recent of these cases was for a client that intended
to do business with his defendant by providing rock cutting
equipment and the defendant to use his labor to produce the
expected product for sale. With continuing disagreement as
to which party was to pay ongoing expenses the defendant refused
to perform and then converted the client’s equipment
to his own personal use. Counsel filed suit and gained return
of the client’s equipment and also arranged for agreed
purchase of further of the defendant’s equipment useable
by the client in a subsequent business deal.
