Real Estate Agent Denied Commission

Client, real estate agent, sold a commercial apartment complex for a significant purchase price and the broker, owner of the agency determined the client had misrepresented certain facts in the process of preparing real estate sale documents and negotiated closure of the sale between the agent’s client and the seller. Upon closing the sale the broker of the agent withheld the client’s commission amounting to $55,000.00. Seller Enforcement

Clients had leased their residence for nearly two years on a lease option agreement that allowed them a favorable purchase price on or before the end of the term of the agreement. Three months before the two years were over the clients decided to buy the premises and notified the landlord who declined to sell at the original purchase price offering further costs to be paid to allow the sale. The clients sued for breach of contract and for damages amounting to the fair market value of the home plus claimed fraud alleging the landlord never intended to sell at the agreed price invoking a claim for punitive damages triple the value of the home. Malpractice

A third client was given an overdose of blood thinner medication and not properly monitored to discover condition of client of too little ability in the blood to clot, causing risk loss of life with a cut or bruising of the skin or muscles. Upon discovery the client was hospitalized for a period of days to bring the patient’s blood level of the drug back to normal. Client sued medical providers for negligence and damages were paid with settlement out of court. Read more …

Auto Accident

Three clients in a vehicle struck by defendant head on and two receiving significant injuries needed further coverage than the $50,000 allowed for the defendant driver’s policy of $50,000 per person, $100,000 or two persons maximum. The driver, being underinsured for the injuries he had caused did provide, through this councel, the maximum coverage of $50,000 to two of the three clients. The back seat client had a broken back in several places. She received the defendant driver’s $50,000 and then received $100,000 on the client driver’s underinsured provisions. Counsel further recovered another $50,000 from the client’s own insurance for a total recovery of $200,000. The client driver, with a crushed foot received the defendant driver’s $50,000 as well as $100,000 from her own underinsured policy provisions. The third client, with lesser injuries, recovered sufficient for his injuries with payment from the driver’s underinsured coverage. Read more …

Estate litigation provided by the firm includes case where decedent mother provided daughter quit claim deed leaving mother’s home to daughter for daughter to provide life time care for the mother. Two other sons were thus left out of the inheritance when mother unexpectedly died with deed in effect and daughter had long since moved out of the home and had not provided the care expected. Mediation provided resolution to the two sons with payment by sister for their interest in the mother’s home.Read more …
